The following are the terms and conditions that apply to the rental of equipment from Laba Depan Welding Enterprise (LD). By accepting equipment furnished under this agreement, the Renter accepts and agrees to these terms and conditions.
Delivery
Transportation is not provided unless stated in written quotation. The Renter is responsible for all delivery charges incurred on all equipment and accessories rental, both outbound and inbound, from the designated LD’s workshop. If LD agree to deliver and/or retrieve the rented equipment, additional delivery and handling charges will be added to the Renter’s invoice.
Fuel Consumption
For any rented equipment that requires diesel fuel to operate, the Renter will be responsible for the diesel fuel consumption.
Maintenance
The Renter shall keep and maintain the rented machine, equipment and tool during the terms of the rental at cost and expense of the Renter. The Renter shall keep the equipment in a good state of repair, however, normal wear and tear is excepted.
Enter Rental premise
The Renter shall allow LD or its agent to enter the premises where the rented equipment is stored or used at all reasonable times to conduct periodical maintenance and inspect the state and condition of the rented equipment. If entering the premises requires any security pass or permission, upon request, the Renter will be responsible in obtaining the pass for LD at Renter’s costs and expenses.
If the Renter is in default of any of the terms and conditions of this agreement, LD, and its agents may at any time enter the Renter’s premises where the rented equipment is stored or used at all time and recover the rented equipment.
Damage
Normal wear and tear of the machine, equipment and tool from reasonable and proper usage are acceptable. However, the Renter is responsible for damage to the rented items due to abuse, misuse, or negligence. The Renter agrees to pay the charges to repair rented items for such damage. All damaged items have to be returned to LD for analysis of the repair cost. Failure to return the items will be deemed as missing.
Loss or Missing
The Renter agrees to pay for any damage, loss and disappearance of the equipment, regardless of cause. The Renter is responsible for keeping the equipment, tools and accessories in good repairable and operating condition.
In Event of Malfunction
LD makes no warranty of any kind regarding the rented equipment. In the event of a malfunction and the equipment fail to operate, the Renter will need to stop the use and notify LD. LD will either repair the equipment at the premise or provide the Renter with a replacement unit. In no event shall LD be liable for direct, indirect, special, incidental or consequential damaged (including loss of profits).
Rental Period
The rental period begins on the day of delivery from the LD’s workshop, and ends on the date before the date the equipments are returned to the originating workshop.
Equipment Usage
The Renter agrees that equipment usage shall be normal and customary, and warrants that Renter is familiar and experienced in the safe operation of the equipment. Training in proper handling and safe operation is strongly recommended for inexperienced or first time users of the equipment.
